1. Scope and contracting party
These terms of use govern the use of the “YUTHI” app (the “App”) between you and
YUTHI life GmbH
Kirchgasse 5
6287 Aesch LU
Switzerland
UID: CHE-189.596.813
Email: info@yuthi.life
(“YUTHI”, “we”, “us”).
The purchase and billing of the subscription are additionally governed by Apple’s terms (see section 4 and section 15).
By creating an account, you confirm that you have read these terms of use and agree to them.
Any deviating terms of users shall not become part of the contract.
2. What the App does
YUTHI is a digital companion for a healthy lifestyle. The App helps you record your daily life in areas such as nutrition, hydration, exercise and training, sleep, relaxation, time outdoors, weight, supplements and blood values, evaluate your entries clearly and pursue your personal goals.
The App includes in particular:
- recording entries manually, by photo, by barcode scan or by dictation;
- evaluations, trends and target values based on your information;
- a coach that uses artificial intelligence to answer questions, recognise meals from text and photos and suggest daily, weekly and training plans (see section 7);
- at your request, the import of values from Apple Health and from your Oura account (see section 11);
- at your request, a weekly comparison with friends you connect with via your code (see section 9);
- reminders and notifications, if you allow them.
The App is available for iPhone; some features can also be used on a paired Apple Watch. It is not offered in all countries; availability in the App Store of your country is decisive.
The exact scope of features results from the current version of the App and its description in the App Store. You are entitled to specific features only to the extent that they were expressly promised when you took out the subscription.
3. Minimum age and account
3.1 Minimum age
You may only use the App if you are at least 16 years old. If you are not yet of legal age, you need the consent of your parents or legal guardian to take out a paid subscription.
3.2 Account
You need an account to use the App. You sign in with your email address and a password of your choice; optionally also with Face ID or Touch ID on your device. If you have not yet set a password, you can sign in via a sign-in link sent by email.
One account per person is permitted. The account is personal and not transferable.
You keep your sign-in details secret and protect your device against access by others. If you notice that someone else is using your account, change your password and inform us at info@yuthi.life.
Your information must be accurate. The more accurate your information, the better the evaluations fit; however, YUTHI does not verify your information.
4. Subscription, free trial and payment via Apple
4.1 Subscription
Use of the App requires a paid subscription. Various terms are available. The term and the price in your local currency are shown to you in the App and in Apple’s purchase dialogue before the purchase; the price shown there is decisive.
4.2 Purchase and payment via Apple
You buy the subscription as an in-app purchase via Apple’s App Store. Payment is processed exclusively by Apple and charged to your Apple account when the purchase is confirmed. YUTHI does not receive payment details such as credit card numbers. Apple’s Media Services Terms and Conditions additionally apply to the purchase.
4.3 Free trial
When you first take out a subscription, Apple may grant a free trial. Its duration is shown before the purchase. If you do not cancel at least 24 hours before the end of the trial, the chosen subscription begins and Apple charges the price shown.
4.4 Automatic renewal
The subscription renews automatically for the chosen term unless you cancel it at least 24 hours before the end of the current term. Apple charges the renewal price within the 24 hours before the end of the term.
4.5 Cancelling and managing
You manage and cancel your subscription in your Apple account settings on the iPhone (Settings › [your name] › Subscriptions). The App takes you there via “My subscription”. A cancellation takes effect at the end of the current term; until then you can keep using the App.
Important: Deleting the App or your YUTHI account does not end the subscription with Apple. Please also cancel the subscription in your Apple account.
4.6 Refunds
Apple decides on refunds according to its terms; YUTHI cannot reverse App Store payments itself. You request refunds from Apple at reportaproblem.apple.com.
Consumers resident in the EU or the United Kingdom have a statutory right of withdrawal of 14 days for digital purchases, which is exercised against Apple.
4.7 Price changes
Price changes for existing subscriptions follow Apple’s rules. Apple informs you in advance and obtains your consent where required. If you do not agree to an increase, the subscription ends at the end of the current term.
4.8 Taxes
The prices shown in the App and in the App Store are final prices. Any taxes are accounted for by Apple in accordance with the rules of the respective country.
5. Referral programme
You can recommend the App with a personal code. If an invited person takes out a subscription with your code and makes their first actual payment, we credit you with additional days of use. The number of days is shown in the App.
Credited days follow on from your paid subscription or your free trial. They have no cash value, are not paid out and are not transferable. Codes may not be distributed via advertisements, voucher portals or mass messages; we may revoke credits resulting from misuse (e.g. your own secondary accounts). We may change or end the programme with effect for the future; days already credited remain.
6. Not a medical device, no medical advice
YUTHI is not a medical device and does not make diagnoses. The App is not intended to detect, prevent, monitor, treat or alleviate diseases.
All evaluations, target values, plans and notes — including those of the coach — are for general information and orientation. They do not replace medical advice, diagnosis or treatment. Never change a treatment prescribed by a doctor or the way you take medication because of content in the App.
Talk to a doctor before changing your diet, taking supplements or starting a training programme, especially if you have pre-existing conditions, are pregnant or breastfeeding, take medication or have an eating disorder.
Values from devices such as the Apple Watch or the Oura ring, as well as your own entries, may be inaccurate. The App shows these values as they are supplied or entered.
In a medical emergency, contact the emergency services immediately — for example 144 in Switzerland, 112 in the EU, 999 or 112 in the United Kingdom, 911 in the USA — and not the App.
7. Notes on the AI coach
The coach is an AI system. Its answers are generated automatically by a language model of Anthropic PBC (USA); no human answers.
- Answers may be wrong or incomplete. Language models can misstate facts, misrecognise meals or quantities and overlook connections. Check important information before relying on it.
- The coach only knows what you have recorded in the App, and only an extract of it. It cannot examine you and does not know your medical history.
- The coach gives no diagnoses, no medication dosages and no assessment of interactions. It may decline requests or refer you to a professional.
- The coach is not intended for emergencies or crises. In an acute crisis, contact the emergency services or a counselling service in your country.
- For each answer, we transmit your message, attached images or documents and an extract from your profile and your entries to Anthropic. Your email address is not transmitted; of your name, only your first name. Details are set out in the App privacy policy (section 4).
- Do not enter health data or other personal data of other people in the chat without their consent.
You may not use the coach to circumvent its safeguards, to generate unlawful or harmful content or to query the App by automated means.
8. Your obligations
You undertake to use the App only for your own private, non-commercial purposes. In particular, you may not
- upload content that is unlawful, infringes the rights of third parties, glorifies violence, is pornographic or shows other people who have not consented;
- share your account with other people or let third parties use it;
- copy, sell or rent the App or its content or offer it commercially to third parties;
- reverse engineer, decompile or modify the App’s program code, unless this is mandatorily permitted by law;
- circumvent security measures, query the App by automated means (e.g. bots, scraping) or disrupt its operation.
If you breach these obligations, we may remove content and suspend or terminate your account in accordance with section 16.
9. Your content
Your entries, photos, documents and messages remain your content. You grant us the simple, free-of-charge right to store and process this content and to transmit it to the service providers we use, to the extent necessary to operate the App and provide its features. This right ends when the content or your account is deleted.
Photos you choose as a profile or motivation picture during onboarding are automatically checked for impermissible content. Impermissible images are not accepted.
If you use the friends comparison, the people you are connected with via your code see your display name and the weekly values you release for it. You can end releases and connections at any time; your shared values are then deleted.
We do not use your content for advertising, do not sell it and do not pass it on for training AI models.
10. Health data and data protection
In the App you can record health data if you wish — for example medication, blood values, symptoms, cycle, sleep or heart rate values. These data are particularly sensitive personal data. We process them only with your explicit consent, which you can withdraw at any time. You are not obliged to provide any of this information.
How we process your data, where it is stored, to whom it goes and what rights you have is set out in the App privacy policy. It is not part of these terms of use, but applies to every use of the App.
You can download your data in the App at any time (Settings › Legal › “Export all my data”) and delete your account yourself (see section 16).
11. Connected services (Apple Health, Oura)
At your request, the App can import values from Apple Health and from your account with Ōura Health Oy (Finland). The connection is voluntary; the App can be used without it.
- The use of these services themselves is governed exclusively by the terms and privacy policies of their providers. YUTHI is not responsible for their availability, measurement accuracy or changes.
- You grant and withdraw access to Apple Health in iOS. You grant the Oura connection at Oura and disconnect it in the App under Settings › Connections.
- If a provider changes or discontinues its interface, the connection may cease in whole or in part. There is no entitlement to a particular connection.
Which values the App reads and how they are stored is described in the App privacy policy (sections 6 and 7).
12. Availability and further development
We strive for the highest possible availability of the App but cannot guarantee uninterrupted operation. Maintenance, security updates, technical faults, outages of service providers (e.g. hosting or language model) and force majeure may lead to temporary restrictions. Some features — in particular the coach — require an internet connection.
We continuously develop the App and may change, replace or discontinue features if there is an objective reason (e.g. technical development, legal requirements, security) and the App remains reasonable for you overall. If an essential feature is dropped during a paid term, we will inform you in advance.
To keep the App running securely and without errors, it may be necessary to install updates. We do not support older versions of the App or iOS indefinitely.
13. Liability
13.1 Principle
YUTHI is liable without limitation for damage caused by us intentionally or through gross negligence, for damage resulting from injury to life, body or health and under the Swiss Product Liability Act.
13.2 Slight negligence
For slight negligence, we are liable only for breach of essential contractual obligations — that is, obligations whose fulfilment makes the use of the App possible in the first place and on which you may rely — and limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded to the extent permitted by law.
13.3 No liability for health decisions
Since the App does not replace medical advice (section 6), we are not liable for decisions you make on the basis of evaluations, plans or answers from the coach, unless we acted intentionally or with gross negligence and section 13.1 provides otherwise.
13.4 Data and third-party services
We are not liable for the accuracy of values supplied by devices or connected services (section 11) or for outages of these services.
13.5 Auxiliary persons
The above limitations also apply in favour of our employees and auxiliary persons.
14. Rights to the App
The App, its content and design, the “YUTHI” brand, the logo, the characters, texts, images and program code are protected by copyright and trademark law and belong to YUTHI or its licensors.
For the duration of your subscription, you receive a simple, non-transferable right to use the App on Apple devices that you own or control for your own private purposes — within the scope of Apple’s usage rules. No further rights are granted.
15. Relationship with Apple
Apple’s standard Licensed Application End User License Agreement additionally applies to the App. In the event of conflicts, these terms of use take precedence to the extent permitted by Apple.
- These terms of use are concluded only between you and YUTHI, not with Apple. YUTHI alone is responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App. Please direct questions and complaints to YUTHI (section 19).
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
- YUTHI, not Apple, is responsible for claims relating to the App — for example product liability claims, claims that the App fails to conform to legal or regulatory requirements (including the use of HealthKit) and claims under consumer protection or data protection law.
- If a third party claims that the App or its use infringes its intellectual property rights, YUTHI, not Apple, is responsible for the investigation, defence and settlement.
- You confirm that you are not located in a country that is subject to a U.S. Government embargo or that has been designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms of use and may enforce them against you.
16. Termination and deletion
16.1 By you
You can delete your account in the App at any time without giving reasons (Profile › “Delete account”). Your profile, all entries, your chat history, your photos, your Oura connection and your push identifier are removed immediately and permanently — on the server and on the device. The deletion cannot be undone. Download your data beforehand if you want to keep it.
You cancel the subscription with Apple (section 4.5). Deleting the account does not end the subscription; YUTHI does not refund any term that has been paid for but not used. Refunds are governed by Apple’s rules.
16.2 By YUTHI
We may suspend or terminate your account for good cause, in particular in the event of serious or repeated breaches of section 8, misuse of the referral programme or where a legal obligation requires it. Where reasonable, we will warn you beforehand and give you the opportunity to comment.
If we discontinue the App altogether, we will announce this in the App at least 30 days in advance. You can download your data until then.
16.3 Retention
After the end of use, we delete your data in accordance with the periods set out in the privacy policy. Statutory retention obligations remain reserved.
17. Changes to these terms
We may amend these terms of use with effect for the future if there is an objective reason — for example new features, changes in law or case law, or changes to Apple’s terms. We will inform you of material changes in the App at least 30 days before they take effect.
If you do not agree with a change, you can cancel your subscription and delete your account. If you continue to use the App after the change takes effect, the change is deemed accepted; we will expressly point this out to you in the notice.
You can find the current version in the App and at yuthi.life/agb-app.html.
18. Governing law and place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-law rules.
The place of jurisdiction is Lucerne, Switzerland.
If you are a consumer, the mandatory provisions of the law of your country of residence remain applicable insofar as they grant you more extensive protection. The mandatory places of jurisdiction for consumers likewise remain reserved; in particular, you may sue and be sued at your place of residence.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
19. Final provisions and contact
Language: These terms of use are available in several languages. For users resident in Switzerland, Germany and Austria, the German version is authoritative; for all others, the English version — as in the App privacy policy.
Assignment: YUTHI may transfer the contract to a successor as part of a transfer of the business. We will inform you of this in advance; you may then terminate.
Severability: If a provision is wholly or partly invalid, the remaining provisions remain valid. The statutory provision takes its place.
Contact: For questions, complaints or concerns about the App, you can reach us at info@yuthi.life.
